ConstructAhead — Terms & Conditions
Last updated: 17 October 2026
SIMPLE TO USE. SERIOUS ABOUT THE JOB.
These Terms & Conditions govern the use of ConstructAhead's website, online store, application, digital tools, software systems and associated services.
ConstructAhead is an Australian business name operated by Alan George Wust, ABN 14 608 767 441, an individual sole trader based in Queensland, Australia.
By purchasing, accessing or using ConstructAhead products or services, you agree to these Terms & Conditions, subject to your rights under applicable law.
1. About ConstructAhead
ConstructAhead provides digital construction planning, estimating, workforce, safety, productivity, operational management and business-support tools.
Our systems are intended to help individuals and businesses plan better, work safer and build smarter.
Available functionality depends on the product purchased, account permissions, service availability and the features expressly offered at the time.
2. Digital products and purchases
ConstructAhead products are delivered digitally unless expressly stated otherwise.
Following successful payment and purchase verification, eligible products are intended to unlock through the customer's ConstructAhead account.
Customers are responsible for providing accurate account information and maintaining access to their registered email address.
If a purchased product fails to activate, customers should contact ConstructAhead for assistance.
All prices are displayed in Australian dollars unless otherwise stated.
ConstructAhead is not currently registered for GST and does not currently charge GST on its sales.
3. Product licences and lifetime access
Purchasing a ConstructAhead digital tool generally grants the customer a non-exclusive, non-transferable licence to use that tool for its intended purpose, subject to the product description and applicable law.
Ownership of the underlying software, branding and intellectual property does not transfer to the customer.
Where a product is advertised as providing lifetime access, ConstructAhead will honour the access commitment represented to the customer at purchase.
The precise scope of lifetime access must be read together with the product description and any specific terms disclosed before purchase. ConstructAhead will not retrospectively reduce an access entitlement in a manner inconsistent with its contractual obligations or Australian Consumer Law.
4. Subscriptions
Some ConstructAhead products and systems may be offered through recurring subscriptions.
Subscription prices, billing frequency, included features and applicable cancellation conditions must be disclosed before purchase.
Customers may cancel subscriptions using the cancellation arrangements provided for their subscription.
Cancellation and refund rights are governed by the disclosed purchase terms, our Refund Policy and applicable Australian Consumer Law.
ConstructAhead will not make undisclosed recurring charges or intentionally conceal material subscription conditions.
5. Refunds and Australian Consumer Law
ConstructAhead does not offer voluntary change-of-mind refunds for digital products or subscriptions.
This does not affect customers' statutory rights.
Where goods or services fail to meet applicable consumer guarantees, customers may be entitled to repair, replacement, refund, cancellation or compensation, depending on the circumstances.
Our published Return & Refund Policy provides further information.
Nothing in these Terms excludes, restricts or modifies rights or remedies that cannot lawfully be excluded.
6. Construction safety and professional responsibility
ConstructAhead provides planning, calculation, information-management, reference and record-keeping assistance.
ConstructAhead does not replace:
- Qualified engineers or other competent professionals.
- Approved engineering drawings and specifications.
- Safe Work Method Statements (SWMS).
- Site-specific risk assessments and procedures.
- Manufacturer instructions, equipment load charts and operating limitations.
- Required licences, inductions, training, permits or supervision.
- Applicable legislation, regulations, codes and standards.
Users must independently verify information before relying on it for safety-critical work.
Where a ConstructAhead output conflicts with an authoritative project requirement, lawful instruction or applicable safety obligation, the authoritative requirement takes precedence.
7. Calculations, estimating and PLAN LENS
Construction measurements, quantities, estimates, take-offs, drawings analysis and related outputs depend on the accuracy and completeness of information provided.
Outputs may be affected by incorrect dimensions, drawing scale, revisions, image quality, assumptions, waste factors, site conditions and other variables.
Users must review and verify results before purchasing materials, undertaking construction, submitting tenders or making financial commitments.
PLAN LENS and other drawing-analysis features do not replace certified drawings, engineering approval or competent professional verification.
Uncertain, incomplete or estimated results must not be treated as verified construction instructions.
8. READY, workforce and operational systems
READY and related ConstructAhead systems may assist with project readiness, workforce allocation, competencies, equipment, logistics, safety, materials, procurement and operational planning.
Users and organisations remain responsible for verifying the accuracy of their records, employee qualifications, medical and competency requirements, equipment suitability, permits, approvals and site-specific obligations.
An automated readiness result, warning or recommendation is not a certification that work is legally or operationally safe to commence.
Employers and organisations are responsible for lawful workforce administration, workplace notices, permissions, employment obligations and appropriate supervision.
9. Safety QR, SWMS, SDS and product information
ConstructAhead Safety QR features may provide access to safety documents, product information, inductions, handling instructions, videos and other workplace resources.
Organisations using these features are responsible for ensuring that linked documents are current, accurate, relevant to the site and accessible to authorised workers.
Scanning a QR code, watching a training clip or acknowledging a safety document does not by itself establish competency, regulatory compliance or authorisation to perform high-risk work.
Safety alerts and notifications are supplementary controls and must not replace appropriate on-site safety systems.
10. Illusion AI and automated assistance
Illusion is ConstructAhead's AI-assisted support capability.
AI-generated responses, summaries, suggestions, calculations and recommendations may contain errors, omissions or outdated information.
Users must verify important information, especially where safety, engineering, legal, financial, employment or regulatory consequences may arise.
Illusion does not replace qualified professional advice, competent supervision or required human approvals.
Any AI-assisted action that changes business records, communicates externally or affects important operational decisions should be subject to the permissions and confirmation mechanisms provided by the relevant feature.
11. Accounts, permissions and security
Users must provide accurate account information, keep credentials secure and use ConstructAhead only for lawful purposes.
Users must not impersonate others, falsify records, bypass security controls, interfere with the service or access information without authorisation.
Organisations are responsible for assigning appropriate permissions to their personnel and promptly removing access when it is no longer authorised.
12. Customer data and records
Customers retain their rights in the business information, documents, project records, photographs and other content they lawfully upload or create.
Customers grant ConstructAhead the permissions reasonably necessary to host, process, display, secure and provide the services they request.
Customers are responsible for having the lawful authority to upload, process and share information concerning employees, contractors, clients and other individuals.
Data access, retention, deletion and export arrangements are governed by the applicable service functionality, our Privacy Policy and legal obligations.
13. Privacy and confidentiality
ConstructAhead handles personal information in accordance with its published Privacy Policy and applicable privacy laws.
Users must not upload confidential, sensitive or personal information unless they have appropriate authority and the relevant service is suitable for that information.
Organisations remain responsible for their own workplace privacy and confidentiality obligations.
14. Financial, taxation and business information
ConstructAhead may provide budgeting, estimating, invoicing, tax-reference and other business-support functionality.
Such information is provided for general assistance and does not constitute personalised accounting, taxation, financial, investment or legal advice.
Users remain responsible for checking financial information and obtaining professional advice where appropriate.
15. Weather, mapping and third-party services
ConstructAhead may display or link to information supplied by external providers.
Weather, mapping, fuel, transport, supplier, tender and other third-party information may be delayed, incomplete or inaccurate.
Users must verify critical information with the relevant authoritative source.
Third-party services may have separate terms and privacy practices.
16. Intellectual property
ConstructAhead branding, software, original designs, interfaces, written content, templates and proprietary systems are owned by or licensed to ConstructAhead unless otherwise stated.
Customers may use purchased products for their permitted business or personal purposes.
Users must not unlawfully reproduce, distribute, resell, reverse-engineer or commercially exploit ConstructAhead's protected intellectual property.
Nothing in this section restricts rights that cannot lawfully be excluded.
17. Service availability and changes
ConstructAhead aims to maintain reliable service but cannot guarantee uninterrupted availability.
Maintenance, security incidents, hosting failures, internet outages and third-party disruptions may affect access.
ConstructAhead may update or improve its services. Material changes affecting paid entitlements will be managed consistently with contractual obligations and Australian Consumer Law.
18. Limitation of liability
To the extent permitted by law, ConstructAhead is not responsible for losses caused by incorrect user inputs, misuse of tools, failure to verify safety-critical information or third-party services outside its reasonable control.
Nothing in these Terms excludes, restricts or modifies liability, consumer guarantees or remedies where doing so would be unlawful.
19. Changes to these Terms
ConstructAhead may update these Terms to reflect changes in services, technology or legal requirements.
The updated version will display its effective date.
Changes will not retrospectively remove accrued rights or lawfully binding purchase commitments.
20. Governing law
These Terms are governed by the laws of Queensland, Australia, and applicable Commonwealth laws.
Nothing in this section limits any right a customer has to bring proceedings in another jurisdiction where applicable law permits.
